Q: What is Geographical Indication of Goods (Registration and Protection)Act, 1999 ?

Ans: The Geographical Indications of Goods (Registration and Protection) Act, 1999 seeks to provide for the registration and better protection of geographical indications relating to goods in India. It is governed and directed by the WTO Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS). The Agreement on Trade-Related Aspects of Intellectual Property Rights is an international legal agreement between all the member nations of the World Trade Organization. TRIPS was negotiated during the Uruguay Round of the General Agreement on Tariffs and Trade (GATT) in 1986–1994.  The headquarters of WTO is also in Switzerland.

Its headquarter is in Geneva  Switzerland.   WIPO promotes the protection of IP(IntellectualProperty) throughout the world . Intellectual Property is the property that arises from the human intellect. It is the product of human creation.

Ans:   The properties are of two types:  1. Corporeal Property  2. Incorporeal Property  Corporeal Property is a property which is tangible in nature whereas Incorporeal property is the property which is intangible in nature. The examples of Corporeal Property are lands, Goods, etc. The examples of Incorporeal property are lease, patents, servitudes, easement , copyright, trademark, etc. The intellectual property is an Incorporeal property but its value is at par with Corporeal property.

Q: What are the major acts of intellectual property ?

Ans:  The major acts of intellectual property are as follows:  For functional and technical inventions, there is Patents Act, 1970 and amended in 1999 ,2000 and 2005.  Patent provides the  exclusive rights to the invention for a certain period of time. For purely artistic works, there is Copyright act, 1957 and amended in 1982, 1984, 1992, 1994, &1999.  Copyright protects the original work of authorship. For symbol, logo, word, sound, colour, design, etc, there is trademark act, 1999 amended in  2000.  Trademark protects the product from making similar product.

Q: Difference between patent, copyright and trademark ?

Ans: A patent protects new inventions, processes, or scientific creations, a trademark protects brands, logos, and slogans, and a copyright protects original works of authorship.
